Terms and Conditions

1. GIFT HOUSE TERMS AND CONDITIONS

K&L Gift House trading as Gift House issues vouchers which entitle the voucher holder a range of gifts and experiences throughout Ireland and the United Kingdom. The fulfilment of the experience will be carried out by the Gift House Gift Partners. Each voucher will state the experience and contain a unique code which must be stated for any correspondence with Gift House Customer Care and Gift Partners.

1a. GIFT HOUSE EXPERIENCES

Upon arriving for your experience you must present and surrender your voucher to the Gift Partner in order to avail of your experience. Please do not arrive to the Gift Partner without your voucher as Gift House cannot be held liable for any relating costs that may be incurred. Once a specific date has been booked with a Gift Partner, you will automatically become bound by the terms and conditions that individual suppliers may have. Please check with your chosen supplier for their full list of terms and conditions. Please note that experiences are subject to change without notice. This does not affect your statutory rights. Lost vouchers cannot be replaced and experience providers will not allow an experience to take place if the voucher is not provided. Gift House and its associated suppliers will not accept any vouchers which are damaged or photocopied.

On purchase of a physical gift the relevant Gift Partner will be notified automatically of your order. Your confirmation email will provide delivery timelines. Should there be a delay in receiving your purchase, please contact the relevant Gift Partner directly.

2. VOUCHER DESCRIPTIONS

Gift House outline all product offerings based on information provided by each experience provider. Each experience description and duration provided by Gift House are intended to offer customers a general idea of the experience and is not considered binding. All images on the site are for illustrative purposes only and do not form any contract between you and Gift House. From time to time the experience provider may change, amend or withdraw their experience and Gift House cannot be hold liable should this occur. Gift House cannot be held responsible for descriptions by or on any third party or agent sites. Experiences may occasionally be withdrawn for reasons outside of our control, and Gift House cannot be held liable for any costs incurred as a result of this. Should this occur, you or your recipient will be advised and offered the opportunity to exchange your voucher for one with the same face value. Where an alternative can be offered, Gift House will not offer a refund.

3. PLACING AN ORDER

Placing an experience or voucher order with Gift House shall be deemed to be full and unconditional acceptance of the Terms and Conditions of Gift House. Placing a physical product order shall be deemed to be full and unconditional acceptance of the Terms and Conditions of Gift House and the Gift Partner. Physical product orders are delivered via the Gift Partner and the delivery time and Gift Partner contact details are advised on the order confirmation email. Prices are displayed in € euro. Prices are inclusive of VAT at the appropriate rates and if your order requires postage or courier delivery this will be charged at point of check out. Gift House reserves the right to decline to process an order for any reason whatsoever. The contract is between you and Gift House and the Gift Partner (where applicable), once your order has been processed and payment has been received. If a gift cannot be fulfilled for any reason Gift House will refund all monies paid. If a duplicate order is made and the duplicate order has been dispatched we ask customers to return any duplicates immediately. If both vouchers are used, Gift House will be entitled to claim payment for both vouchers. Gift House may revise these terms and conditions at any time by updating this posting. Any changes in these terms and conditions will be effective immediately when they are posted on the site. We reserve the right, at our discretion, to change, modify, add, or remove portions of these terms and conditions at any time. You should visit this page periodically to review the terms and conditions.

4. LIABILITY

We reserve the right to vary the prices of the gifts which we offer. Some Gift House Partners may offer additional services at an extra cost. These additional services are entirely optional and you are under no obligation to purchase them. Any additional services purchased from a Gift House Partner will be governed by that operator’s terms and conditions and do not form any part of your contract with Gift House. Where travel vouchers are purchased, the traveller is strongly advised to take out adequate travel insurance. Some Gift House Partners may also offer additional insurance which can be purchased directly with the Gift House Partner.

5. INDEMNITY

You agree to defend, indemnify, and hold harmless Gift House, its officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting whether directly or indirectly from your use of the site or material (including software) or your breach of the terms of this Agreement. Gift House shall provide notice to you promptly of any such claim, suit, or preceding and shall assist you, at your expense, in defending any such claim, suit or proceeding.

6. AVAILABILITY

All gifts and experiences are subject to availability with your chosen Gift House Partner and in some cases is weather permitting. We advise contacting your Gift House Partner before your experience to confirm that the event is going ahead. To avoid disappointment Gift House recommends that you book your experience well in advance in order to avoid disappointment and please note some experiences require a minimum advance notice period. All gifts and experiences must be availed of prior to the expiry as stated on your voucher. Once a date has been booked with a supplier your Voucher will be deemed to be used.

7. EXPERIENCE DURATIONS

Experience durations are outlined on the site if they have been provided by the supplier. This offers a guideline to the experience as is to be used as a guide only. Most experiences have ‘open’ days therefore other members of the public will be also taking part in the activity. Some experiences are subject to restrictions. These may include age, height, weight, physical and medical restrictions, and may vary from experience locations so please check before making your booking. It is your responsibility to ensure that you choose an experience appropriate for the intended recipient and it is the responsibility of the recipient to double check that the restrictions are not prohibitive.

8. EXPIRY OF GIFT VOUCHERS

All gift must be booked and taken prior to this expiry which is printed on your voucher. Any unredeemed vouchers after the stated expiry date will be deemed invalid and no liability will be accepted by Gift House expired vouchers cannot be extended for any reason.

9. GIFT HOUSE PARTNERS

Gift House has contracted agreements with its Gift Partners regarding their standard of performance. Once a booking has been made with a Gift Partner the participant is bound by the Terms and Conditions of that Gift Partner. This includes any restrictions applied by your Gift Partner and Gift House cannot be held responsible for the safety standards or the quality of the experience or any loss or damage incurred by you whilst participating in the experience. This responsibility is solely of the Gift Partner. By purchasing or redeeming a voucher with Gift House you acknowledge that experiences are dependent on certain factors beyond the control of Gift House and agree that Gift House is not liable for the cancellation, postponement or alteration of any experience for reasons beyond its reasonable control. If your experience is cancelled for any reason by the Gift Partner for any reason beyond their control the Gift Partner will arrange to re-book your experience at a mutually agreed time. Gift House will not be held responsible in the event of a cancellation. All physical products purchased are delivered via the Gift Partner. The delivery time and Gift Partner contact details are advised on the order confirmation email. Please contact the Gift Partner for any queries on your delivery.

10. CANCELLATION OF YOUR EXPERIENCE

Once you make a booking with a Gift Partner you are bound by their terms and conditions. Please ensure you fully understand their rules regarding changing or cancelling a booking especially at short notice as a refund will not be offered in the case of infringement of these rules. In some cases the Gift Partner may agree to change your date, this is solely at the Gift Partners discretion and depending on their availability.

11. FEEDBACK

Gift House welcomes all feedback and if you have any queries Gift House would be delighted to hear from you. The Customer Care team are here to help from Monday to Thursday from 9.00am to 5.30pm and Friday from 9.00am to 5.00pm on 01 5545772. If you encounter any problems on the day please ensure to bring it to the attention of the Gift Partner who will do their upmost to ensure matters are resolved. If the matter was not resolved on the day by the Gift Partner please write to Gift House within seven days of your experience and Gift House will ensure to investigate the matter in full. When writing to Gift House please ensure to include your voucher number, participants name and the Gift Partner. Please write to customercare@gifthouse.ie. The Gift Partner will also have the opportunity to investigate the matter and respond.

12. PRIVACY POLICY

Gift House ensure the highest standard of security of your personal data, therefore your email will only be used to send you information on Gift House (if requested), Your details you not be disclosed to a third party under any circumstances other than stated in our Privacy Policy under Disclosure of your Information. At Gift House your privacy is of our highest importance therefore your details will only be used to process orders, gain information and data regarding our products and services. Please click here to read our privacy policy. Our site may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites.

13. DELIVERY

Gift House cannot be held responsible for any delivery delays (postal or courier) or goods damaged during delivery. All physical products purchased are delivered via the Gift Partner. The delivery time and Gift Partner contact details are advised on the order confirmation email.

14. DISCOUNT CODES

Discount codes are issued from time to time and are subject to availability. Only one discount code can be used per order and cannot be used against delivery. Discount codes can be withdrawn at any time without notice and only apply to online orders.

15. GIFT CARDS

(A) RETAIL GIFT CARDS

Retail gift cards are sent within 3 business days via email once order has been placed. All retail gift cards are subject to a service charge of €2.49 per purchase.

(B) GIFT HOUSE GIFT CARDS

Gift House gift cards can be used only for purchases on www.gift-house.com. Any remaining balance will be left on your Gift House gift card to spend on future purchases. You can check your Gift House gift card balance on www.gift-house.com.

(C) GIFT HOUSE TRAVEL GIFT CARDS

Gift House travel gift cards are operated by Gift House in conjunction with travel partner Platinum Travel, TA 0634. When using your Gift House travel gift card, all travel bookings must be made through Gift House including all package holiday bookings which must be booked through Platinum Travel, via Gift House.

16. ALCOHOL SALE POLICY

The purchase of gifts that include alcoholic beverages must only be made by persons aged 18 years or over. The recipient of gifts that include alcoholic beverages must only be made by persons aged 18 years or over.

17. GENERAL

This site is controlled and operated by Gift House based in the Republic of Ireland. Those who choose to access the site from other locations do so on their own initiative and are responsible for compliance with local laws. Any disputes, claims or proceedings arising out of or in any way relating to the site shall be governed by the laws of Ireland. The Irish Courts shall have exclusive jurisdiction for the purpose of any proceedings arising out of or in any way relating to the site. Without prejudice to the foregoing, Gift House may seek provisional or protective relief in the courts of another State prior to, during or after any substantive proceedings have been instituted in Ireland and Gift House may bring enforcement proceedings in another state on foot of an Irish judgement. If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term. This agreement constitutes the entire agreement between you and Gift House with respect to the use of the site. Gift House may at any time and without liability modify, suspend or discontinue the site or any materials (or any part or specification thereof), with or without notice, for any valid technical, operational or commercial reasons.
